Terms

These are the terms for using realpng. They are written to be read, not to be survived. If a clause is unclear, write to us and we will explain it.

  1. These terms

    These terms form a binding agreement between you and Flower Execution Limited, a company registered in the Hong Kong Special Administrative Region with its registered office at Flat A, 15/F, Hiller Commercial Building, 65-67 Bonham Strand East, Sheung Wan, Hong Kong ("we", "us"), the operator of realpng at realpng.com, including its web app, REST API and MCP server (the "Service"). By creating an account, creating an API key or using the Service, you confirm that you have read these terms and agree to them.

    If you do not agree, do not use the Service. If you are agreeing on behalf of a company, you confirm that you are authorised to bind it.

  2. Eligibility

    You must be at least 18 years old and legally able to enter into a contract. You must not be barred from using the Service under the sanctions or export rules that apply to you or to us.

    We may decline or end access at our discretion. Nothing here obliges us to accept any account.

  3. The Service

    The AI Detector checks whether an image or a video reads as AI-generated and reports on its metadata and provenance data. The Optimizer re-renders and resamples an image, adjusts its colour and grain, and saves the result as a new file that does not keep the original's metadata. For a video it resamples every frame and adjusts its colour and grain, and saves the result as a new MP4 that does not keep the original's metadata. Each optimized image or video comes with an optimization score, which is 100 minus our detectors' AI reading of the result.

    Both tools are automated. Results can be wrong, and clause 11 explains what that means for you.

  4. Your account and keys

    Your account and your API keys are personal to you. You must not sell, share, sublicense or transfer them without our written consent, and you must keep your sign-in details and keys secret.

    You are responsible for everything done through your account and keys, including by anyone you allow to use them. If you think someone else has used them, tell us straight away.

  5. Plans and payment

    Some features are free within the limits shown on our pricing page. Others need a paid plan.

    Purchases are handled by Polar as merchant of record, so you buy from Polar and Polar's terms apply to the payment. Polar charges any VAT or sales tax and issues your receipts. We do not hold your payment details.

    Plans renew automatically at the end of each period until you cancel. You can cancel at any time, and your plan stays active until the end of the period you paid for. Unused allowances do not carry over unless your plan says so. If a payment fails, we may pause or downgrade your plan until it is paid.

    We may change our prices. A new price applies to your plan only from your next renewal after at least 30 days' notice, and you can cancel before then.

  6. Refunds

    Fees are non-refundable, except where these terms or the law say otherwise, or where we choose to refund. To ask for one, write to us or to Polar.

    If you are a consumer in the EU or the UK, you normally have 14 days to withdraw from a purchase. Because the Service is supplied straight away, you agree that it starts at once and that you lose that right once you start using a paid plan.

  7. Your images

    You keep every right you have in the images you submit and the results you receive. You grant us a limited, non-exclusive, royalty-free licence to host, copy, process and transmit them only as needed to provide the Service and to comply with the law. The licence ends when they are deleted, on the schedule in our privacy notice. We never use them to train models.

    You confirm that you own your images or have every right and permission needed to submit them, including the consent of any person shown in them where the law requires it.

    We delete uploads and results within two days, and the copies behind a share link when that link ends, so keep your own copies of anything you need.

  8. What is not allowed

    You must not use the Service to:

    • deceive people about where an image came from or how it was made, in a way that could harm them
    • commit fraud, impersonate a real person, or fake identity documents, evidence, receipts or records
    • spread disinformation, including about elections, public health, emergencies or public figures
    • strip, hide or alter AI labels, provenance data or watermarks where the law, a contract or a platform's rules require you to keep or disclose them, including the disclosure duties in the EU AI Act and similar laws
    • tamper with copyright notices, rights management information or watermarks on work you do not own or have no right to change
    • infringe anyone's copyright, trade mark, privacy or publicity rights
    • process sexual content involving minors, intimate images shared without consent, or sexual or degrading images of real people without their consent
    • harass, threaten, defame or exploit anyone, or break any law that applies to you

    You must not get around usage limits, rate limits, payment or security measures, probe or disrupt the Service, reverse engineer or extract the models or methods behind it except where the law allows, use it to build a competing product, or resell access to it without our written consent.

    We monitor activity for these behaviours. Breach of this clause entitles us to remove content, suspend or end your access immediately and report illegal activity to the authorities.

  9. What you publish

    You are responsible for how you use the images the Service produces, and for meeting any labelling, disclosure or advertising rules that apply where you publish them. An optimized image does not keep the original's metadata, so if those rules ask for a label or disclosure, you must add it yourself.

  10. API and MCP use

    Keep your keys out of public code, client-side apps and shared files. You are responsible for all use of them and any charges they run up. Respect the rate and usage limits of your plan. We may throttle or block requests that exceed them or that harm the Service, and revoke any key that is leaked or abused.

    If you give us a webhook address, you are responsible for that endpoint and for checking the signature on each call. If you give us an image link, you must have the right to let us fetch it. If you connect the MCP server to an AI assistant or agent, you are responsible for what it does on your behalf.

    We may change, version or retire endpoints and tools. We will give reasonable notice of changes that break existing integrations.

  11. No warranty

    The Service is provided as it is. We do not warrant that it will be uninterrupted or error-free.

    Detector results are estimates. A result is not proof either way, and you must not rely on it alone for legal, financial, employment, academic or other decisions about anyone. An optimization score is our detectors' reading of the result today, and not a promise that any platform will accept or show the image. We make no promise about how any platform, review or third party tool treats an optimized image, that it keeps every detail of the original, or that it reaches any number of views. Nothing in the Service is a guarantee of reach or results.

  12. Limits on liability

    To the extent the law allows, we are not liable for indirect, incidental, special or consequential loss, or for lost profits, revenue, data, goodwill or anticipated savings. Our total liability to you for all claims in connection with the Service, taken together, is limited to the greater of what you paid us in the 3 months before the event giving rise to the claim, or 50 USD. Any claim must be brought within one year of the event giving rise to it.

    Nothing here limits liability that cannot be limited by law, including for death or personal injury caused by negligence, or for fraud, and nothing here limits rights you have as a consumer that cannot be limited by contract.

  13. Indemnity

    If you use the Service for a business, you will cover our reasonable losses and costs, including legal fees, from any claim that arises from your images, your use of the Service or your breach of these terms.

  14. Our rights

    The Service, its software, models and design, and the realpng name and logo are ours or our licensors'. These terms give you a limited, non-exclusive, revocable, non-transferable right to use the Service under them and nothing more. You must not alter our logos, use them in a way that suggests you are us, or register any domain, account name or trade mark that includes them or a confusingly similar term.

    If you send us feedback, we may use it freely.

  15. Suspension and termination

    Either of us may end this agreement at any time, for any reason. You can close your account whenever you like. We may suspend your account or keys immediately where we reasonably suspect a breach of clause 08 or a risk of fraud, and will tell you when we do.

    If we end your access without cause, we will refund prepaid fees for the unused part of your plan. On termination your right to use the Service ends and we delete your data as our privacy notice describes. Clauses that by their nature should survive termination will do so.

  16. Changes

    We may change these terms. Changes take effect when published on this page. If a change matters, we will tell you by email or in the Service at least 30 days before, unless it is needed sooner for legal or security reasons. Continuing to use the Service after a change takes effect means you accept it.

  17. Your personal data

    We process the personal data you give us to run the Service, bill you, meet our legal and tax obligations and prevent abuse. Our privacy notice explains what we collect, who processes it on our behalf, how long we keep it and the rights you have over it.

  18. Governing law and disputes

    These terms, and any dispute or claim arising out of or in connection with them, including non-contractual ones, are governed by the laws of the Hong Kong Special Administrative Region, without regard to its conflict of law rules. The courts of the Hong Kong Special Administrative Region have non-exclusive jurisdiction, which means we may also bring proceedings in the country where you are established. If you are a consumer, this does not deprive you of the protection of the mandatory laws of the country where you live.

    These terms, together with the privacy notice, are the entire agreement between us about the Service. If any clause is found unenforceable, the rest continues to apply. Our failure to enforce a clause is not a waiver of it. You may not assign this agreement without our consent. We may assign it in connection with a reorganisation or sale of our business.
